The school-level scientific research topic on the content of "Current situation of corruption and improvement of anti-corruption laws in our country" was chaired by Dr. Do Gia Thu - Deputy Dean of the Faculty of Economic Law, Dai Nam University with the participation of Deputy Dean of the Faculty of Economic Law, Dai Nam University - Dr. Do Thi Minh Thu and MSc. Pham Thi Phuong of the Legal Department, Government Inspectorate. The topic has been accepted and recognized according to Decision No. 21001/QD-DN dated February 10, 2020 of the President of Dai Nam University with the result classified as Excellent.

SCHOOL LEVEL SCIENTIFIC RESEARCH TOPICS:

“CURRENT STATE OF CORRUPTION AND IMPROVING THE LAW ON ANTI-CORRUPTION IN OUR COUNTRY TODAY”

Topic The school-level scientific research on the content of "Current situation of corruption and improvement of anti-corruption laws in our country" was chaired by Dr. Do Gia Thu - Deputy Dean of the Faculty of Economic Law, Dai Nam University with the participation of Deputy Dean of the Faculty of Economic Law, Dai Nam University - Dr. Do Thi Minh Thu and MSc. Pham Thi Phuong of the Legal Department, Government Inspectorate. The topic is part of the 2018 - 2019 school year plan of the Graduate Training Institute, implemented according to Decision No. 12503/QD-DN dated February 25, 2019 of the President of Dai Nam University on assigning scientific research topics for the year 2018 - 2019. The topic was implemented within 01 year from November 2018 to December 2019.

The Law on Anti-Corruption was issued in 2005, amended and supplemented in 2007 and 2012, serving as an important legal basis for the current fight against corruption. After 10 years of implementing the Law on Anti-Corruption, the work of Anti-Corruption has achieved many positive and important results, contributing to improving the effectiveness and efficiency of state management; helping to improve the business environment; and gradually helping to create a public and transparent institutional environment. However, the fight against corruption still faces many limitations and shortcomings. The situation of corruption is increasingly serious, occurring in all areas of social life, but has not been pushed back. The scale and level of corruption are increasingly large, including foreign elements. Petty corruption is rampant, spreading to the non-state sector. Although the Law on Anti-Corruption has recently been amended and supplemented with many new regulations, especially in the 2015 Penal Code and the 2018 Law on Anti-Corruption, many regulations are of poor feasibility or not consistent; guiding documents are slow to be issued; the implementation is “hot above, cold below”, so the effectiveness of Anti-Corruption activities has not yet changed significantly, and has not yet met the people's demands.

Corruption is a common social phenomenon in all countries. Corruption is always associated with power but is also governed by control of power. In Vietnam, corruption has truly become a national disaster, a chronic, painful disease for the Party, the State and all honest people. Corruption, in the forms of material corruption, power corruption or political corruption, is an inevitable consequence of loopholes in socio-economic management. In any field where there are loopholes in management, there is room for violations and corruption to arise. Corruption in Vietnam has become widespread, this behavior occurs in all sectors, at all levels, even in agencies with the function of fighting corruption. More dangerously, a number of officials and civil servants consider corruption as a matter of course, and carry it out openly, causing people to feel indignant and lose faith in the Party and the State. For anti-corruption activities to be effective, the legal system must be complete and stable.

The topic of the group of authors has identified acts of corruption; assessed the current situation of corruption in our country and the causes of corruption. Analyzed the shortcomings of current laws on anti-corruption and raised issues to continue to improve laws on anti-corruption. In the current conditions, our Party and State need to constantly innovate legal mechanisms and policies, ensure the consistency between regulations on specialized socio-economic management and regulations on anti-corruption; promptly amend and supplement outdated regulations, prevent the exploitation of mechanisms and policies for enrichment and corruption; continue to improve the organizational system of law enforcement agencies, especially specialized agencies in anti-corruption; build a team of professional and clean anti-corruption cadres and civil servants.

The group of authors' topic has made a new contribution in both theory and practice to the improvement of the law on corruption prevention and control. The topic has been accepted and recognized according to Decision No. 21001/QD-DN dated February 10, 2020 of the President of Dai Nam University with the result of Excellent classification.
